Discandooo’ Terms & Conditions

These Terms & Conditions are applicable to all purchases on www.discandooo.com (”The Website”) and regulate all matters between you and us. All agreements are concluded in English.

When you make a purchase on the Website you accept these Terms & Conditions. We urge that you read the Terms & Conditions carefully and that you understand all details, as they apply to you as a consumer.

1. About us

Discandooo (”us”, ”we” or ”ours”) is a company registered in Germany CKS Online Essentials GmbH.

2. Conclusion of the purchase agreement

As soon as you receive an order confirmation from us by e-mail, a purchase agreement has been concluded. Until you receive your order confirmation, we may cancel your order in whole or in part, for example as a result of sold out goods. If we need to cancel your order, we will of course inform you by e-maile. 

Check your order confirmation

Please check that all the information in your order confirmation is correct and that the information matches your order. If you notice any errors in your order, please call or write to customer service as soon as possible.  

3. Payment

On the Website, you can pay for your purchases with the following payment cards: Visa, and MasterCard.

4. Prices & Fees

All prices include German VAT and other German taxes. Prices are daily prices.

For purchases of goods from Germany, consumers may have to pay local VAT. It is your responsibility as a consumer to declare purchases when required by local authorities.

If import problems should occur or should you be charged additional taxes and charges for the imported, this does not concern Discandooo.

5. Security and receipt

Security
To protect your card information, you will be transferred to a separate payment page upon payment on the Website. The payment solution is provided by our payment provider Altapay A/S, which is certified to handle your payment data, ensuring that all information is encrypted and sent via SSL to Altapay. This means that only Altapay can read your payment data.

6. Collection of your order

Discandooo does not deliver your goods, so you can choose to:
a) Pick up your order from us at our warehouse
b) Engage a carrier to pick up and deliver the goods to you

The responsibility and risk of the goods will pass to you as soon as your order has been collected from us. From that moment on, we are no longer responsible for the products and their possible damage or destruction during transportation.  

7. Order for others

You may not order goods for resale and all purchases you make must be for personal use or consumption.  

8. Beverages without bottle fee (pant)

Beverages without a bottle fees may only be used in a private context, and you accept not to consume these beverages in Germany.

9. Export declaration

When you purchase goods on the Website, you agree to these Terms & Conditions and to the following export declaration:   

"I declare that I have a permanent residence in a Scandinavian country and that within 24 hours I export the goods to a Scandinavian country. I undertake not to consume beverages without a bottling fee in Germany. I also agree that the purchased goods may only be used in a private context. "

10. Complaints

Everything is carefully selected and sorted in order for you to get the best possible products. Should you receive a product that does not live up to standards, please contact our customer service by e-mail as soon as possible and within 3 days of receiving or picking up your order. You can choose whether you want the money back for the specific product or whether the amount shall be transferred to your Discandooo account. Discandooo is entitled to demand a return of the item.

The above, of course, also applies if you find that your order is otherwise inadequate.

The Consumer Purchase Act applies when you make a purchase, and you have 3 years' right to claim that a product is defective, if it is a product that is not for household consumption. According to our choice, the right of claim includes the possibility of getting the goods repaired, exchanged, receiving a discount, or returning the money in case of a legitimate claim. It is not a legitimate complaint if the defect in the product has arisen as a result of wear, age, misuse, or other behavior that has caused damage to the product. You must make a complaint about the defective product soon after you have discovered the defect.

11. Returns

If you wish to return an item this must be done within 14 days from the day the goods have been collected from us.

You can only exercise your right to return if the goods are essentially unchanged, and therefore you cannot return goods that have been damaged.

Please note that there is no right to return food, beverages and other similar items for the household.

If you wish to return, you must inform us clearly and unambiguously before the expiration of the cancellation deadline by e-mail and the goods must be returned to our warehouse.

As a customer, you are responsible for the costs of return.

Consequences of returns

If you choose to return an item, we will refund the payment without undue delay and in any event within 14 days of receiving the product. Repayment will be made using the same method of payment that was used when ordering unless you explicitly have accepted or requested anything else. You will not be charged a fee for the refund.

You can return the goods to us by post or freight at your own cost and you are responsible for the item during the shipment.

The goods must be returned to us at our warehouse (see address above) without undue delay and no later than 14 days from the date on which you have notified to exercise your right of return. Please note that we do not accept products that have passed the expiration or best-before date.

We recommend that you save documentation for the return of the goods.

You are liable for a decline in the value of the products if this is caused by your handling of the products, which was not necessary to determine the quality, function, nature and characteristics of the goods. You are entitled to examine the products in the same way as you can in a physical shop, which means that you cannot use it. If you have used it in t and we cannot sell it again or cannot sell it at full price again, we will deduct in the amount that we return to you. If the item

12. Applicable law

Current law

All legal relations between the parties are determined according to the legislation of the Federal Republic of Germany, however, the legislation on the international purchase of movable property does not apply. For consumers, this choice of law only applies to the extent that the protection provided is not revoked by mandatory provisions in the legislation of the state where the consumer has his habitual residence.

If the customer acts as a trading company, a legal entity under public law or a foundation under public law with its registered office on the territory of the Federal Republic of Germany, the seller's registered office is the sole place of jurisdiction for all disputes in connection with this agreement. If the customer has its registered office outside the territory of the Federal Republic of Germany, the seller's place of business is the sole place of jurisdiction for all disputes arising in connection with this agreement, if the contract or the claims under the agreement can be attributed to the customer's professional or commercial business. In the above-mentioned case, however, the seller has the right to appeal to the court at the Customer's domicile in any case.

13. Complaints - Information on appeal possibilities

This platform acts as a point of contact for the out-of-court settlement of disputes arising from online purchases or service agreements involving a consumer.

The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration committee.

15. Alcohol

It is permitted to order alcohol to Finland via the internet from another EU country.

Finnish tax is payable, otherwise the alcohol can be withheld by the Customs Office.

In cases where the buyer orders the transport of alcohol to Finland, for example by a transport company, the following applies:

The buyer must pay Finnish tax on the alcohol. Before the goods are transported from the other EU country, the buyer must report the goods to the Finnish Tax Agency and provide security for payment of the tax on alcoholic beverages, see further the brochure here

Please note that Finnish tax, when ordered on the internet, is payable regardless of the amount of alcohol.

When buying alcohol on the Website you confirm that you are above 20 years of age. You are not allowed to buy alcohol on the Website if you are not 20 years old.

16. Pricing and Availability Disclaimer

All items are subject to availability. We will make our best efforts to inform you as soon as possible if the goods you have ordered are not available or if shipment may be delayed. All prices are subject to change without notification. We occasionally run promotion prices as incentives or limited-time opportunities for qualifying purchases made during the promotional time period. Due to the time-sensitive and promotional nature of these events, we are unable to offer price protection or retroactive discounts, or refunds for previous purchases in the event of a price reduction or promotional offering.

Discandooo reserves the right to change these terms and conditions without notice.

18. Product substitutions for (temporarily) unavailable items.

In connection with the order, we check whether there are enough items in stock or on their way to us. In these completely unusual times when we are affected by the coronavirus, we are finding that a number of manufacturers are offering us a smaller range in order to guarantee sufficient quantities for all customers. During this time it can therefore happen that, for example, the beer or chocolate variant you have ordered cannot be delivered. In this case, however, we will try to deliver a different variant that meets the same requirements. In addition, an item may not be available when your order is about to be packed. It may be due to the non-delivery by one of our suppliers, that an item was damaged during packaging or we discover during packaging that an item does not meet our high-quality requirements. Of course, we do everything we can to find the best replacement. When we replace an inaccessible item with a suitable replacement of the same or greater value and quality, you "only" pay for the original item (e.g. we can replace a 100g bag of candy with a 200g bag and you only pay for the ordinary 100g bag). Of course, if we are unable to deliver your item or a suitable replacement item, this item will not be invoiced.
